A Statement by the Asian Human Rights Commission



SOUTH KOREA: Massive arrest against protesters is imminent



Since the government of South Korea agreed with the United States of America to import beef on April 17, the people of the South Korea have expressed their deep concerns about the agreement due to the reports of bovine spongiform encephalitis (mad cow disease) having been found in the U.S. The failure of both governments to give reassurances on the condition of the beef has done nothing to assuage the people’s fears. Mad cow disease is a deadly disease for which there is no known cure. It may lay dormant in the infected person for years before symptoms are revealed or felt.





지난달 17일 한국 정부가 미국 쇠고기를 수입하기로 합의한 이래 한국민들은 미국에서 광우병이 발생했다는 보고 때문에 협정에 대해 깊은 우려를 나타내고 있다. 양국은 쇠고기 상태에 대해 안심시키는데 실패함으로써 국민들의 우려를 불식시키지 못했다. 광우병은 아직 치료방법이 밝혀지지 않은 치명적인 병이다. 광우병은 감염되면 수년간의 잠복기를 거쳐 증상이 나타난다.





In the hope that the government will accept the people's demands, tens of thousands of people, composing of family members including school students, have voluntarily come before the Cheonggyechoen (Cheonggye stream), Seoul, in a candlelight vigil, asking the government to renegotiate the agreement and stop importing beef from the U.S. until the people of South Korea are assured that it is free of the disease. The people have held candlelight vigils, not on-ly in the capital Seoul, but also in major cities across the country for the last 17 days.





정부가 국민들의 요구를 받아들이기를 바라면서 학생을 포함한 가족단위의 국민들 수만명이 청계천에 자발적으로 모여 쇠고기 수입에 대해 재협상하고 국민들이 이 광우병으로부터 완전히 자유로워질 때까지 수입을 중단할 것을 요구하며 촛불시위를 벌이고 있다.





Students from middle schools and high schools have been reportedly prohibited from taking part in the vigils and several teachers were dispatched in order to identify their students wearing school uniform. It is also reported that school principals have publicly announced suspensions of students and announced the prohibition of other students from taking part. The students submitted a complaint to the National Human Rights Commission of Korea regarding the restriction of freedom of expression and assembly.





소식에 따르면 중고생들이 이 시위에 참여하는 금지돼있고 몇몇 학교들은 교사들을 보내 교복을 입은 학생들을 찾아내고 있다는 것. 또 다른 소식에 따르면 몇몇 교장들은 공개적으로 참가학생들을 정학시키겠다며 다른 학생들이 집회에 참여하지 못하게 하겠다고 공언하고 있다. 학생들은 표현과 집회의 자유를 제한하는 것과 관련, 국가인권위원회에 제소하기도 했다.





Due to pressure from the people, including students, the government has postponed the public announcement, which will be effective immediately on-ce it is made. However, it is reported that it will be announced either tomorrow or the day after tomorrow, (May 27 or 28). Being frustrated, some of protesters started to march on the street, which is illegal under the domestic law called the Act on Assembly and Protest after the candle light vigil on May 24. In response the riot police used their police shields to attack the peaceful marchers at 4am, May 25. It is reported that at about 68 protesters have so far been arrested and several were injured at the time. It is also reported that in Cheonbuk province, Mr. Lee Byung-Ryeol set fire to himself, shouting against the agreement on May 25 and his condition is currently serious. In the meantime, the Minister of Justice Mr. Kim Kyung-han has already proclaimed that the police will arrest protesters at any future demonstration.





학생들을 포함한 국민들의 압력으로 정부는 일단 진행되면 즉시 효력을 발휘하도록 돼 있는 고시를 연기했다. 하지만, 소식에 따르면, 정부는27일이나 28일쯤 고시를 진행할 방침이다. 이에 분노한 시위대는 24일 촛불문화제가 끝난 뒤 현행법상 집시법 위반인 거리행진을 시작했다. 이에대해 전투경찰은 25일 새벽 4시께 평화적으로 행진하고 있는 시위대에게 방패공격을 감행했다. 소식에 따르면 당시 약 68명이 체포되고 다수가 부상을 당했다. 또 25일 전북지역에서 이병렬씨가 쇠고기 협의에 반대하는 구호를 외치며 분신을 시도, 현재 중태이다. 한편 김경한 법무장관은 향후 시위 참가자들을 체포하겠다고 밝혔다.





The Asian Human Rights Commission urges the government of the South Korea to release the arrestees without condition and guarantee the right of peaceful assembly of the people which is enshrined in the Korean Constitution as well as International Covenant on Civil and Political Rights (ICCPR), to which the South Korea is a state party. It also urges that the government must ensure the safety and freedom of the people who take part in the candlelight vigil that is to be held tonight and in the future, and that it must guarantee the right of peaceful assembly in such a way as to protect protesters. Finally the AHRC calls upon the government to amend the Act on Assembly and Protest in compliance with the Constitution as well as international standards.





아시아인권위원회는 한국정부가 회원국으로 있는 시민적 및 정치적 권리에 관한 국제협약 (ICCPR)뿐만 아니라 한국헌법에도 보장된 평화적 집회에 관한 권리에 따라 무조건 연행자들을 석방할 것을 촉구한다. 또한 아시아인권위원회는 한국정부가 오늘 밤 및 앞으로의 집회 참석자들의 안전과 자유를 보장할 것, 시위대를 보호하는 방식으로 평화집회의 권리를 보장할 것을 촉구한다. 마지막으로 아시아인권위원회는 국제규범과 한국헌법에 부응하는 방향으로 집회 및 시위에 관한 법률을 개정할 것을 한국 정부에게 요청한다.
